This website is owned and operated by Refresh Agency, S Corp. d/b/a The Passion Institute (“company,” “we” or “us”) with HQ in Boulder, CO, United States. By using the site, you agree to be bound by these Terms of Service and to use the site in accordance with these Terms of Service, our Privacy Policy and any additional terms and conditions that may apply to specific sections of the site or to products and services available through the site or from the company.

We reserve the right to change these Terms of Service or to impose new conditions on use of the site, from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the site after we post any such changes, you accept the Terms of Service, as modified.

Intellectual Property Rights

All material available on this site such as workshops, training programs, events, blogs, video blogs, articles and digital products are protected by trademark, copyright and Intellectual Property laws and belong to The Passion Institute. The site is provided solely for your personal, noncommercial use. All products are personal, and you are not allowed to sell, lend, give the purchased product away or in any other form distribute products without prior written agreement from Sandja Brügmann and The Passion Institute.

You may not use the site or the materials available on the site in a manner that constitutes an infringement of our rights or that has not been authorized by us. More specifically, unless explicitly authorized in these Terms of Service or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the site. You acknowledge and agree that any contributions originally created by you for us shall be deemed a “work made for hire” when the work performed is within the scope of the definition of a work made for hire in Section 101 of the United States Copyright Law, as amended. As such, the copyrights in those works shall belong to company from their creation. Thus, company shall be deemed the author and exclusive owner thereof and shall have the right to exploit any or all of the results and proceeds in any and all media, now known or hereafter devised, throughout the universe, in perpetuity, in all languages, as company determines.

In the event that any of the results and proceeds of your submissions hereunder are not deemed a “work made for hire” under Section 101 of the Copyright Act, as amended, you hereby, without additional compensation, irrevocably assign, convey and transfer to company all proprietary rights, including without limitation, all copyrights and trademarks throughout the universe, in perpetuity in every medium, whether now known or hereafter devised, to such material and any and all right, title and interest in and to all such proprietary rights in every medium, whether now known or hereafter devised, throughout the universe, in perpetuity.

Force Majeure

Events outside The Passion Institute’s control, which is not reasonably foreseeable, shall be considered force majeure, meaning that The Passion Institute is released from The Passion Institute’s obligations to fulfill contractual agreements. Examples of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products – for example, restrictions, warnings, ban, etc.

Throughout the site, we may provide links and pointers to Internet sites maintained by third parties. Our linking to such third-party sites does not imply an endorsement or sponsorship of such sites, or the information, products or services offered on or through the sites.

We do not guarantee the accuracy, completeness, or usefulness of any content. We are not accountable for the results obtained through use of products and services on this site. All products and services provided by the company is provided ‘as is’ and without warranties of any kind, either expressed or implied. Third Party Products

Content & Tone

We have no obligation whatsoever to monitor any of the content or postings on the blog roll, social media site or other public forums on the site, membership classrooms or related to the site. However, you acknowledge and agree that we have the absolute right to monitor the same at our sole discretion. In addition, we reserve the right to alter, edit, refuse to post or remove any postings or content, in whole or in part, for any reason and to disclose such materials and the circumstances surrounding their transmission to any third party in order to satisfy any applicable law, regulation, legal process or governmental request and to protect ourselves, our clients, sponsors, users and visitors.

We expect a positive and supportive communicative tone by all users.

Registration

To access certain features of the site, we may ask you to provide certain demographic information including your name and email address, zip code and country. You agree to provide true, accurate, current and complete information about yourself as prompted by the site’s registration form. If we have reasonable grounds to suspect that such information is untrue, inaccurate, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the site. Such results are the sole responsibility of the individual participant.

We have developed all our products, websites, videos, newsletters, programs or other content, with every effort to ensure that we accurately represent our programs and their ability to grow your business and improve your life. However, the company does not guarantee that you will get any results using any of our ideas, tools, strategies or recommendations, and nothing on our sites is a promise or guarantee to you of future success and happiness.

You expressly agree that your use or inability to use The Passion Institute products is at your own risk. By purchasing any products or services, you accept, agree and understand that you are fully responsible for your progress and results from your participation, and that we offer no representations, warranties or guarantees verbally or in writing of any kind. You alone are responsible for your actions and results in life and business, which are dependent on personal factors including, but not necessarily limited to, your skill level, knowledge, ability, dedication, business savvy, network and financial situation, to name just a few. We do not offer psychological services.

You also understand that any testimonials or endorsements by our customers or audience represented on our programs, websites, and content are their freely offered personal experience, and have not been scientifically evaluated by us. Furthermore, the results experienced by individuals may vary significantly.

Payment

All products remain The Passion Institute property until payment is received in full. The applicable price is that set on the date of which you place your order. Shipping costs and payment fees are recognized before confirming the purchase.

All payments through The Passion Institute are handled and transacted through the third party dedicated gateway, Paypal, to guarantee your protection.

You can pay with VISA, Mastercard, American Express or through your Paypal account. You will receive an invoice immediately following your purchase via the email address you provided at the time of your purchase. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway chosen for the transaction, as they are responsible for the transactions made.

Digital products are delivered immediately following your purchase through either the email address provided or login access to membership and online course forums. If you wish to change the email address you provided at time of purchase, log in to your Simplero profile and correct it here under ‘my profile’.

The GOAL Digger Sessions is a monthly subscription service. You can sign up any time that fits you. You can elect to pay per month and your subscription will be charged every 30 days, or at a discounted price for an annual payment, that renews every 356 days. You can unsubscribe from the monthly Goal Digger Sessions anytime. An annual subscription is binding for the year.

Refund Policy

Your purchase of a product, service or ticket to an event may or may not be eligible for any refund. On all online format products and services (instant access to files, products, audios, videos etc) you are not entitled to an exchange or refund. All purchases are binding and nonrefundable.

If you are unable to attend a workshop or program and notify us in writing more than 30 days prior to start date, you are entitled to a 50% refund of the paid price. Notification of cancellation less than 30 days prior to the start date of a course or workshop will result in no refund given. You are welcome to sell or gift your spot to someone else. Please notify us of the name of the person attending in your place.
